Kerala HC to look into Maintainability of pleas Alleging Judicial Misconduct

The Kerala High Court questioned the maintainability of two pleas before it. The two pleas were filed against the Judicial Misconduct against one of its sitting judges as well as two of its retired judges pertaining to the orders passed by them in the cases related to the Maradu flats demolition issue.

The Single Judge Bench of Justice P B Suresh Kumar while dealing with the petitions said that “If writ petitions like these are entertained, how will judges work? How will they render judgement? They are also human beings.”

The Court stated that it would only do the examination of the maintainability of the two pleas and therefore denied to look into the alleged Judicial misconduct matter.

Advocate Yeshwanth Shenoy represented the petitioner and suggested forming an in-house committee to examine such allegations made on judicial misconduct against the judges and to make a copy available for him on any reasonable orders passed on his complaints.

One of the pleas seeks directions to the Chief Justice of the Court to call for a Full Court meeting of the Apex Court pertaining to the complaint which was filed against the sitting Judge.

The second plea seeks for the formulation of the in-house committee to discuss the complaint filed against the two retired judge 

The Court will further hear this matter on September 6.
