Kerala HC Directs Medical College to Implement New Curfew Orders Subject to Minimum Conditions

The Kerala High Court directs all Medical Colleges to abide by the notice released by the State Government relaxing hostel.

Single – judge bench Justice Devan Ramachandran, remarked that the stipulated closing time of gates for both girls and boys hostel is 9:30 p.m., but it give certain flexibility to students to enter after that time, subject to certain bare minimum conditions. The exceptions, are mainly for the fresher students who are not familiar with new environment and the place.

The Kerala Hc observed, “Prima facie, I find this order to be a welcome step forward, particularly when Smt.Parvathy Menon – learned Standing Counsel for the Kerala Women’s Commission, affirms that it does not brook of any gender discrimination”

The plea was filed by medical students against the impugned notification issued by the Higher Education Department barring female students from going out of the Hostel after 9.30 PM.

The Court held that it is responsibility of Government to make the campus safe, the imposition of curfew in women’s hostel is unlawful and discriminatory.

It was thus of the view that the aforementioned order ought to be implemented forthwith.

The case is listed for hearing on 22.12.2022 for further consideration.
