Karnataka High Court Proceedings to be live streamed from Today

A Gazette notification by the Karnataka government notified that the Proceedings of the Karnataka High Court and the Tribunals under its Jurisdiction would be streamed live from January 01, 2022.

A ten-minute delay would be there in the live streaming which could be modified on the basis of the directive of the Court.

The notification titled “Karnataka Rules on Live Streaming and Recording of Court Proceedings, 2021 had been issued on the basis of the directions give in the two Public Interest Litigations (PILs). These paved the way for the Proceedings to get streamed live.

There are exceptions to the live streaming of Proceedings in a few cases related to Sexual Offences, Proceedings under IPC Section 376, matrimonial disputes, Gender-based Violence, Juvenile Justice Act, cases that provoke enmity among communities, recording of Evidences, non-public discussions between Advocates and Cross-Examination. The Petitioners are also allowed to submit applications which object the live streaming.

The discussions among the Judges, instructions given to the Administrative staff by the Judge, notes taken by the Judges and notes made by the Advocates are also not to be streamed live.

Personal Information like the Date of Birth, Address, Identity Card Number, Bank Account information and the information about the close relatives and Witnesses shall be either deleted or muted during the live streaming.

The live streaming of the Proceedings was started by the High Court as a pilot on May 3, 2021. It was started in the two Public Interest Litigation’s (PIL) related to the Karwar port expansion project. Also, the Proceedings of PIL’s related to lakes were live streamed.

An entity or an Authorized person shall record, share or disseminate the Proceedings streamed live or archival data is stated by the Rule. Prosecution under Indian Copyright Act, 1957 and Information Technology Act, 2000 shall take place if any kind of violation is observed.
