Karnataka HC Quashes PIL Seeking Online Betting and Gambling Ban

The Karnataka High Court has dismissed a PIL requesting to Ban all Online Betting and Gambling.

A Division Bench comprising Chief Justice Ritu Raj Awasthi and Justice Sachin Shankar Magadum Quashed the PIL by Sharada D R.

Through his PIL, Sharada requested the Court to pass certain guidelines for the Government to ban all online gambling and betting.

The Bench dismissed the Plea calling it ‘Infructuous’, because in a recement Amendment done by Karnataka Government in Karnataka Police Act,all the online gambling and betting is banned. 

Also, Violation of this will lead to a Jail-Term of 3 years and a Fine of around Rs 1 lakh.

“State government has brought an Amendment in the Karnataka Police Act, 1963 and as such the Writ Petition in the present form has become infructuous,” stated the State Government.

Also, Advocate Shridhar Prabhu, who was appearing for Petitioner agreed that now the Petition is pointless as the aim of the Petition is already fulfilled.

It was argued in the Petition that the Youth of the State is getting diverted because of this online Gambling and Betting.

However, the online Gaming Companies, Challenged the Provision before the High Court.

Replying to the Gaming Companies, Advocate General Prabhuling K Navadgi stated that at present no actions will be taken against them.

It should be noted here that similarly, Gujarat High Court and Tamil Nadu High Court have ordered their respective State Legislatures to explore the possibilities of Regulating the Regime.
