The Karnataka High Court has Ordered Police Officials in charge of Investigations to Rigorously observe the State Government’s Directive and to refrain from disclosing information about Criminal Cases to the Media till the Investigation is done.
A division Bench of Chief Justice Ritu Raj Awasthi and Justice Sachin Shankar Magadum while disposing of a Petition filed by H Naghabhushan R. said, “We have given our anxious consideration to the directions issued by the respondent/State to the police officers not to disclose information regarding details of cases under investigation. The directions are detailed at clauses (a) to (f) of circular dated 11.08.2021.”
The Petitioner had asked the Court to Order the Respondents to draft legislative guidelines to ban indecent and obscene content from being broadcasted as part of news or other programs in the Electronic and print Media.
The request further asks that the Dissemination of such content be deemed a punishable offence with a reasonable deterrent Penalty.
Furthermore, it has been Alleged that as part of news programs, several media organizations are distributing obscene video/partially blurred nude images and videos of various situations.
Furthermore, it was said that while Broadcasting news, TV presenters repeat the filthy language used in the video clips in Order for the public to grasp the language used by two compromising individuals.
According to the Complaint, the Cable TV (Regulation) Act of 1995 lacks any Provision or system to prevent such nefarious Broadcasting.
Despite the fact that Section 5 of the Act states that no person shall transmit or re-transmit any programme through a Cable service unless it complies with the approved programme code, the Petitioner claims that there is no definition for programme code.
