Justice Pushpa Ganediwala judge of Bombay High Court (Nagpur Bench) has resigned from her office. Her resignation came just a day before the end of her tenure as the Bombay High Court Additional Judge.

As per the information received from Judicial Officials, Justice Pushpa Ganediwala on February 11 tendered her resignation to President Ramnath Kovind.

Justice Pushpa Ganediwala was neither recommended for a permanent Judgeship by the Collegium nor was her tenure as Additional Judge extended. As per the sources, she is planning to pursue Arbitration and Litigation before the Supreme Court and High Court.

Justice Pushpa Ganediwala authored the infamous skin to skin Judgment in January last year in a Case under the Protection of Children from Sexual Offence Act (POCSO Act) Case which became one of the most controversial Judgment. Although, the same was overturned by the Apex Court.

Although, she delivered multiple other controversial Judgments that too in the same month. In a Judgment delivered on January 14, 2021 in the Case of Jageshwar Wasudeo Kawle v. State of Maharashtra, she reversed a conviction Order after noting that there was nothing supporting the Prosecution’s Case for rape.

In another Judgment on January 15, 2021 in the Case of Libnus v. State of Maharashtra, Justice Pushpa Ganediwala held that the act of holding hands of a minor or the zip of the pants of the Accused being open at the relevant time, does not amount to Sexual Assault as defined under Section 7 of the POCSO Act.
