J&K High Court refuses to suspend sentence of 3 convicts in Ajit Dogra Murder Case

The Jammu and Kashmir High Court refused to suspend the sentence of life imprisonment of 3 convicts convicted for criminal conspiracy and murder in Deputy Advocate General (DAG) Murder case.

The Bench comprising of Justices Tashi Rabstan and Justice Javed Iqbal Wani observed that all of them were convicted after a complete trial that took place for about 12 years by the Trial Court.

The offence committed by them was a heinous offence against the then serving law officer, Ajit Dogra over a land grabbing issue.

After the DAG lodged a complaint against the convicts for fraudulently selling the land through forged documents, he was attacked with sharp edged weapons which lead to his death in a hospital of Delhi.

The Court observed that the power to suspend the sentence of the Appellant Court is discretionary power and the same can be rejected.

The three convicts, namely Vishal Sharma, Ashok Kumar and Amrish Kajuria, along with the appeal to suspend their sentence, applied for a bail application stating that they were in prison since more than 10 years and there’s no possibility for them to get their appeals disposed in the future.

In conclusion, the Court dismissed the appeal stating that the applicants are not entitled to suspension of sentence on any ground.
