Gujarat HC Grants Bail to Husband of Abetting Suicide of Mentally Depressed Wife

Single Judge Bench comprising Justice Gita Gopi had granted Bail to the accused charged under Sections 306, 498A and 506(2) of Indian Penal Code and under Section 3 and 4 of Prohibition of Dowry Act.

Applicant was alleged of abetting his wife to commit suicide.

The applicant submitted that deceased was suffering from depression even before marriage her parents were aware of it and he provided full support to her.

Deceased used to complain about lack of sleep but doctors observed deceased was improving partially.

Deceased was in depression when she took this drastic step of committing suicide.

The Assitant Public Prosecutor submitted that applicant was torturing the deceased just in seven months of marriage by demanding Rs. 10,00,000 as dowry.

There is proof that father of the deceased transferred Rs. 1,00,000 to the applicant.

The Court after observing fragile mental state of the deceased and duration to the Trial granted Bail to the applicant by furnishing personal bond of Rs. 15,000 and with one surety of like amount.
