Family of Indian Nurse facing Death Penalty in Yemen Moves Delhi HC Seeking Government Intervention

The family of an Indian nurse facing Death Penalty in Yemen approached the Delhi High Court seeking to Order the Indian Government to intervene in the Case through Diplomatic Channels.

The Plea was filed by Nimisha Priya. It states that Nimisha committed the Offence of Murder after she allegedly gave sedatives to a man who kept her as a slave and hid her Passport.

Nimisha, who hails from Kerala had been working in Yemen, when travelling to and from the Country was banned due to the Civil War in 2016. In July 2017, she was Accused of killing a Yemeni National, Talal Abdo Mahdi.

Nimisha alleged that Mahdi had abused and tortured her. She gave him sedatives so that she could search for her passport and return to India, but Mahdi died. She then allegedly cut his body into pieces and dumped it in a water tank.

The Plea before the High Court claims that the deceased had abused her Physically and Financially. He also hid her passport so that she could not return to India. Further, he misrepresented himself as Nimisha’s husband to the Yemeni Authorities due to which she did not to get any aid from them.

The Plea filed through Advocate Subhash Chandran KR said that there is no way for Nimisha’s family to visit Yemen so as to secure her release as travelling to Yemen is not permitted due to the Socio-Political situation there.

The Plea further sought Court Orders to the Indian Ministry of External Affairs to Facilitate Diplomatic interventions as well as negotiations with the family of the Victim on behalf of Nimisha Priya to save her life by paying blood money as the Law of the Land in a time-bound manner.

In case the Government is unable to secure the Appeal, the Plea sought the permission to collect and send money to Yemen for paying blood money to the family of deceased. This may help Nimisha avoid Death Penalty in Yemen. However, financial transactions with Yemen are restricted by the Indian authorities as of now.

It was also mentioned in the Plea that the family sent representations to the Government but did not receive any response.
