Ex-Convict of United Kingdom invoked his “Right to be Forgotten”

Delhi High Court had issued a Notice on the Plea filed by a man Mohammed Umar Ashrafi, Ex-Convict of United Kingdom invoked his “Right to be Forgotten” by seeking the removal of news articles from the public domain that is about his conviction.

Justice Rekha Palli asked for the response of the union of India via the Ministry of Information and Broadcasting, Google LLC, Twitter, Hindustan times and Amar Ujala.

Advocate Rajesh Rai filed the Petition that stated that International Law recognised the rights to reform and the Right to be Forgotten after the Accused has completed his sentence for a crime.

Mohammed Umar Ashrafi (Petitioner) was sentenced to a total of 9 years of imprisonment under the charges of Fraud and Blackmail and was released from prison on 15th March 2021 and thereafter deported to India on 30th July 2021.

Justice Palli noticed that the Right to be Forgotten can be stretched and the rights of a person had to be balanced.

Hence Justice Palli issued notice on the Plea filed by Ashutosh Kaushik(winner of Roadies 5.0 and Bigg boss 2008), demanding removal of all the posts, videos, articles from the public domain that were sensationalizing his past.
