The High Court of Delhi stated that every adult woman is free to reside as per their choice and with any person with whom she wants to stay.
Sulekha’s brother, the complainant, filed a habeas corpus petition, stating that she was kidnapped.
A bench comprising Justice Vipin Sanghi and Justice Rajnish Bhatnagar said in the judgement:
“The police authorities shall also counsel the petitioner (woman’s brother) and the parents of Sulekha not to take the law into their hands or threaten either Sulekha or Babloo.
The mobile phone number of the beat constable of the police station where Sulekha will reside with Babloo should be provided to both Sulekha and Babloo so that they may get in touch with police officials in case of need.”
The petitioner suspected Babloo behind his sister’s kidnapping.
However, Sulekha and Babloo wanted to stay together, and she married him as per her choice.
“Aforesaid being the position, Sulekha is free to reside wherever she wishes and with whosoever she wishes, she being a major,” the court said and provided enough security for their protection.
