The Eastern Caribbean Supreme Court has put a stay on the repatriation of India-born fugitive Mehul Choksi from Dominica.

The order was passed after a habeas corpus petition was filed by lawyers of Choksi stating that he was denied constitutional rights of legal assistance.

The Court order read, “This order is to be served immediately on the Defendants by email and fax and in person, and the Head of Immigration at the Douglas Charles Airport by email and fax.”

In the plea, Choksi’s lawyer Wayne Marsh alleged that his client sustained “Marks of torture” on his body and claimed that he was forcefully picked up from Antigua and Barbuda against his wishes and put in a vessel. He further said that the whole nation should speak out terming it as a “Travesty of justice”.

The matter is related to the PNB scam where Mehul Choksi was charged with fraud of INR 12,000 crore.

The matter to be further heard by the Court on May 28.
