District Judge who resigned due to her Allegations of Sexual Harassment against High Court Judge, gets reinstated

The District Court Judge who had to resign from her post as an Additional District and Session Judge was reinstated for service on February 17, 2022. Earlier an Order for her reinstatement was passed by the Supreme Court.

The District Court Judge had earlier Alleged that she was coerced to resign from her position as an Additional District and Sessions Judge, after she had made Accusations against a Madhya Pradesh High Court Judge of Sexual Harassment.

It was contended by the aggrieved Judge that after she had made the aforementioned Allegations against High Court Judge S K Gangele, she was transferred from Gwalior to Sidhi, and her Plea for staying in Gwalior for daughter’s education was twice rejected by the Madhya Pradesh High Court.

The Petitioner had then filed a Writ Petition under Article 32 of the Constitution of India, challenging an Order of an In-House Committee formed under Orders of the Supreme Court, the Committee had cleared the Accused Judge from all accusations.

The Supreme Court Bench then passed an Order of reinstatement of the aggrieved Judge after it heard her contentions. The Supreme Court order stated that,

“A possibility of her mind engrossed with a feeling, that she was subjected to Injustice by the very Institution of Judiciary, cannot be ruled away.”

The aggrieved District Court Judge was reinstated as an Officer on Special Duty in the Madhya Pradesh High Court.
