Delhi Riots: Delhi High Court Grants Bail to Murder Suspect Bilal

The Delhi High Court granted Bail to Mohd. Bilal, who has been in custody since June 22 last year in a Murder case connected to the Northeast Delhi Riots.

Bilal was arrested in connection with the death of Mudassir, who sustained a Bullet Injury on February 25, 2020, during an Anti-CAA Protest in Kabir Nagar.

Justice Mukta Gupta observed, “In the said video recording, the deceased Mudassir is seen standing with the mob, and is also seen falling down after receiving the projectile. However, in the video recording clip of 35 seconds which focuses on the mob, the Petitioner is not visible. “

The Court further added, “One fails to understand that while the videography was going at the spot, why videography of only 35 seconds when Mudassir got injured was captured and it did not have any videography prior thereto or thereafter.”

The Prosecution claimed that Bilal was observed destroying CCTV cameras near the spot on February 24, 2020.

The State further relied on the statements of witness Babu Dule in connection to the dislocation of the cameras as having witnessed the incident, as well as the statements of Constable Sunder, who had identified Bilal on the basis of CCTV footage.

The Court further stated that, while it was alleged that Babu Dule’s house was in a side lane, the probability of his seeing the exact incident among a mob of hundreds of people from his residence was too remote.

Taking into consideration the “nature of evidence” against Bilal as well as the fact that he has been in custody since June 2020, the Court deems it fit to grant him Regular Bail.

Consequently, the Petitioner is directed to be released on Bail on furnishing a personal bond in the sum of Rs. 50,000 with two surety bonds of the same amount.
