Delhi Riots Case: Delhi Court cautions Police over Non-Preparedness

A Delhi Court on October 4 cautioned an Investigating Officer as he was not prepared to appear in the case related to the North East Delhi Riots. 

Additional Sessions Judge orally remarked that the Investigating Officer did not join the proceedings on time. He also objected to the delay in arranging the photos and videos being relied on by the Prosecution in the said matter. 

The Judge orally remarked, “You (Investigating Officer) did not even join the proceedings on time. It is not the duty of the Court. It is also your responsibility. The last time I asked you, you said you will take time. You should be prepared for everything. Such conduct is not expected out of an Investigating Officer (IO). Don’t push me to write and order. Sit somewhere where you have the internet.”

Prosecutor argued, “They are pelting stones at police officers with a strong intent to cause loss. They were well aware of the consequences of their actions.”

It was also argued that there was deliberate planning by the rioters to spread the riots concerning one particular religion and the said accused can be seen in the CCTV footage holding a stick (danda) in his hand. 

Advocate Ashu Kumar, appearing for Mohd. Faizan submitted that according to the FIR the main conspirators were Natasha Narwal and Devangana Kalita as alleged by the Prosecution. They have been granted bail by the High Court in the said matter. 

Advocate Kumar further added, “Total five accused were granted bail. As far as the role of the Investigating Agency is concerned, without going into the material that they have collected during the investigation, they added the highest gravest offence in the charge sheet so that the same is tried in the Sessions Court. There is no material regarding Section 302 of the IPC.”

The Court was hearing a bail plea filed by Mohd. Faizan involving Sections 186, 353, 283, 332, 323, 307, 427, 120B, 34, and 188 of the Indian Penal Code and sections 25, and 27 of the Arms Act and sections 3, and 4 of the Prevention of Destruction of Public Property Act.

The Court has reserved the order on the Bail plea. The said order will be pronounced on October 10.
