Delhi High Court: Sharjeel Imam to face Charges of Sedition and UAPA

The Delhi High Court while Quashing the Bail Plea of Jawaharlal Nehru University student Sharjeel Imam, Ordered to frame Charges of Sedition and Unlawful Activities (Prevention) Act (UAPA) in the Case of Delhi Riots.

The Additional Sessions Judge Amitabh Rawat passed the Order as, Vide separate Order of even date, Order on charge has been passed. Accused is accordingly directed to be charged for the Offences under Section 124A IPC, 153A IPC, 153B IPC, 505 IPC & 13 of UAPA. Vide separate Order of even date, the application under Section 439 Criminal Procedure Code filed by Accused Sharjeel Imam for grant of regular Bail is dismissed”.

The Charges of Sedition will be framed against him for promoting hatred and enmity between groups, statements inciting public aggression and Unlawful Activities.

The Case was filed with regard to Imam’s provocative speeches with reference to Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC) at Jamia Millia Islamia in December, 2019 and at Aligarh Muslim University in January, 2020.

Imam’s Counsel Advocate Tanvir Ahmed Mir, sought discharge and Bail in the mentioned Case submitting to the Court that Imam was not terrorist or does not have any links with any terrorist organisations. He was just a social activist calling for social and economic unity having no political agenda behind the same.

He also argued that Imam’s speech which was Alleged as Seditious was actually a call for the society to unite and respond to the Government’s policy on CAA and NRC.

However, the Court adjourned the Case and is to frame Charges on February 03, 2022.
