Delhi High Court allows Delhi Govt Panel to look into ‘Oxygen’ Deaths

Delhi High Court allows a High-Powered Committee formed by the Aam Aadmi Party (AAP) Government to look into the deaths caused due to shortage of oxygen during the second wave of COVID-19. 

Delhi Government’s decision to set up the Panel had earlier been Stayed by the Lieutenant Governor of Delhi.

The Division Bench of Justice Vipin Sanghi and Justice Jasmeet Singh took note of the stand of the State Government thatThe Committee will not attribute any fault to any hospital and no compensation will be paid and absorbed by the Government alone. The criteria for determining the compensation will be open for screening.” 

The Government asked the Committee to probe the deaths in such cases where people died due to a shortage of oxygen. 

The Committee is expected to set up a compensation limit to a maximum of Rs. 5 lakh each.

The Bench passed the Order while hearing a woman’s Petition arguing that there wasn’t any reasonable justification for preventing the functioning of the High-Powered Committee as the issues like health or grant of Ex-Gratia monetary benefits to the affected sections of the society are the matters that falls within the ambit of Delhi Government.
