Delhi HC: Govt Don’t need Religious Committee permission to demolish Illegally constructed Temple

The Delhi High Court directed that the Delhi Government may reasonably not need permission from the Religious Panel for demolition of an Illegally constructed’ Temple on a pavement at Defence Colony.

The Court also informed the State’s Home Department to submit the official file before the Court.

Further the Court asked the local Police Station’s Station House Officer (SHO) to appoint a personnel for 24 hours and produce a report, including on visitors and details of persons collecting the offerings.

Furthermore, Justice Rekha Palli stated “There is no clarity as to whether the religious committee purportedly constituted under orders of L-G is required to examine encroachment of such minuscule nature, merely because certain idols are placed on the spot.”

The Court was hearing a Resident’s Plea seeking removal of Encroachment’ in front of his Property.

The Court further highlighted that it wanted to realize what the Religious Committee is meant for.

The Court stated “I don’t prima facie find that for such, two bricks being put on road, you need permission from the religious committee, that can’t be the intent of your L-G’s order.”
