Delhi HC: Drugs Smuggling results addiction amongst Adolescents, Bail Plea under NDPS Act rejected

The Delhi High Court rejecting a Bail Plea under the Narcotic Drugs and Psychotropic Substances Act, 1985 observed that the smuggling of narcotics is resulting in an addiction amongst a sizeable section of the population particularly adolescents and students.

“It has been observed that organised activities of the underworld and the clandestine smuggling of narcotic drugs and psychotropic substances and illegal trafficking in such drugs and substances is resulting in drug addiction among a sizeable section of the public, particularly the adolescents and students of both sexes and the menace has assumed serious and alarming proportions in the recent years which has a deadly impact on the society as a whole”

The Court was hearing the Bail plea of RamBharose from whom 270 grams of smack, which is a commercial quantity was recovered.

Also, an First Information Report under Section 21, 25, and 29 of the NDPS Act was registered against him. Earlier, in November, his Anticipatory Bail was rejected after which he reached the High Court for Bail.

Justice Subramonium Prasadrejected the Bail plea and was of the view that the Petitioner supplied drugs to the peddlers who in turn provided it to the consumers.

Also, since the investigation was at a nascent stage there were no grounds for believing that the Petitioner was not guilty of the Offence.
