Delhi HC Directs Delhi Police to File Counter-Affidavit to Plea of Journalist Zubair

The Vacation Bench of Justice Sanjeev Narula had given two weeks time to Delhi Police to file counter affidavit in reply of the plea made by Journalist Mohammed Zubair who is a co-founder of AltNews. The Court adjourned the matter till July 27.

Zubair had made a plea against detention order passed by Patiala House Court over the complaint on his tweet posted in 2018 which was alleged to be disrespectful for Hindu God and hurting the religious feelings of Hindus.

The Advocate Vrinda Grover who is representing the Zubair in the Delhi High Court submitted that Zubair’s gadget was seized from him which is a violation of his journalistic freedom and while he was arrested the guidelines of Arnesh Kumar case given by Supreme Court was not followed by the police.

The Solicitor General Tushar Mehta who appeared for the government opposed the claim by stating that there are legal provisions according to which devices are seized and also informed the Court that even in 2020 also one complaint was filed against Zubair.

The Police did not find anything in the case of 2020 and that is why Police is about to file closure in that case but in this case related to the post of 2018 police is still investigating the matter.

Zubair was taken into remand by Police on June 27 for a single day by Patiala House Court extended it for four days.

The High Court observed that these four days is going to end on July 2, Zubair will presented before the Magistrate and that is why Court directed that this hearing will not effect that hearing.

Both the hearings will go together without any prejudice.
