Delhi HC asks NDMC clarification for Illegal Hawking in No-Vending Zones

Annoyed with the unapproved hawking in the Walled City region, the Delhi High Court has looked for a clarification from the North Delhi Municipal Corporation (NDMC) on how such exercises are permitted in the no-vending zones.

A Division Bench comprising Justices Vipin Sandhi and Jasmeet Singh guided the city body to document its reaction within three weeks or before the following date of hearing.

The court made the guidelines while it was hearing an ‘urgent’ application filed by Chandni Chowk Sarv Vyapar Mandal (CCSVM), trader’s association.

The application looked for guidelines to Delhi Police and NDMC to guarantee that peddlers and hawkers in the no-selling zones in Chandni Chowk and Subhash Marg shouldn’t be remembered for the study being completed by the civic agency.

The Court also asked for the names of policies and municipal authorities who are authorized to regulate all such activities.

“We direct the respondents to deal with the allegations made in the application. It should be explained as to why the vending and hawking activities are permitted to be carried out in the already declared no-hawking/ no-vending zones,” stated the order.

Senior Advocate showing up for the CCSVM fought that notwithstanding rehashed bearings of the court, peddlers and sellers eliminated by the specialists reoccupied the public spots.

“Instead of fresh instructions, the bench sought to know why previous orders aren’t being complied with. Hence, the judges issued directions to the civic agency to explain why hawkers and vendors are still squatting in areas where such activities are not permitted,” stated Sanjay Bhargava, the President of CCSVM.  

The court also instructed the Town Vending Committee (TVC) to appropriately record every one of the peddlers and merchants consuming space in the no-selling or no-distributing zones independently. 

The next hearing is scheduled for November 10.
