Delhi HC asks inquiry into allegations of encroachment on graveyard land

On January 3, 2022; the Municipal body and other authorities were asked to inquire into the allegations of encroachment on graveyard land in Jamia Nagar, Delhi by the Delhi High Court. The authorities were also directed to demolish it if found to be illegal.

The matter was disposed of by the Division Bench of Justice D N Patel and Justice Jyoti Singh. The authorities were asked to inquire into the allegations and take action after the Bench heard the Petitioner and Respondent Corporation.

The NGO, Janhit Vikas Sanstha had filed the Petition seeking direction to the authorities to demolish the alleged unauthorized and illegal construction encroaching the graveyard in Jamia Nagar.

Advocate Alamgir who appeared for the Petitioner alleged that the private builder had used his power and links with the land mafia to occupy the graveyard land in question and constructed the structure illegally.

The Plea also stated that the illegal construction was still being carried on by the Respondent builders and had constructed a structure up to the 5th floor without any sanctioned plan and not abiding by the Building Bye-laws.

The Petition also stated that the action and inaction of the Respondent authorities were in complete violation of law of the land and of the Judgments passed by the Delhi High Court and the Supreme Court.
