Delhi Govt. To HC: Over 500 Toilets Meant for PwD can be Used by Transgender Persons

The government has informed the Delhi HC that 505 public toilets meant for Persons with disabilities can be used by transgender persons.

Further, nine new public toilets along with 56 more toilets solely for transgender persons are being constructed.

A Bench of Justice Satish Chandra Sharma and Subramonium Prasad granted six weeks time to file fresh report on new toilets constructed.

It was said that the third gender faces harassment, agony and trauma when they are forced to use male or female gendered toilets. It violates their right to privacy.

As, they have no separate toilets they are forced to use male toilets where they face sexual assault and harassment.

The plea also stated that there is no remedy in the Indian Penal Code, that protects transgenders from sexual assault by men, women and other transgender persons.

People, including men, women, and transgenders, feel uncomfortable and hesitate when the third gender uses washrooms which are made for others, the plea submitted, adding this also violates the ‘right to privacy of the third gender.
