Delhi Court directs lodging of FIR against directors of Air Charter Company for Cheating

The Delhi Court has ordered for a Registered FIR against the two directors of Air Charter Service Company for Reportedly failing to equip a man with a helicopter in spite of receipt of payment, stating that the company had an “intention to cheat.” 

Additional Sessions Judge Anuj Agrawal pronounced the Order on the Revision Petition Filed by Anis Ahmad opposing the Magistrate’s Order rejecting his Plea requesting registration of FIR against the duo and an employee for not providing the helicopter for his niece’s wedding even after the payment of Rs. Five Lakh in March 2019.

The Petitioner alleged that the director did not refund the amount paid despite the cancellation of the service and furthermore refrained from picking his calls, after which he heard that they have closed down the office.

He also added that one of the Accused has even threatened him, following which he filed Complaints at Jamia Nagar Police Station and with the Deputy Commissioner of Police (DCP) in September and October 2019 but still no action was taken against them.

Allowing the revision petition, the Additional Sessions Judge stated, “It appears that respondent No.1 and 2 being Directors were having an intention to cheat the revisionist (Ahmad) since the beginning as they did not come up with an explanation as to why no services were provided to revisionist despite receipt of the amount.” 

The Judge further noted that the company did not have any kind of permission from the Competent Authority to give out helicopter services to the Complainant at the appropriate time as Contracted.

The Court claimed that no Criminal Liability can be taken against the employee of the charter service company as he was also cheated and not provided salary for six months.

The Police are directed by the Judge to probe into this as well
