Cow Slaughter Case: Allahabad HC refuses to quash FIR

The Allahabad High Court on Friday refused to quash a First Information Report (FIR) lodged against seven people under Sections 3, 5 and 8 of the Uttar Pradesh Prevention of Cow Slaughter Act, 1955.

The Bench of Justice Saroj Yadav and Justice Ramesh Sinha noted, “The impugned FIR disclosed a Cognizable Offence and that the petitioner was involved in the Cow Slaughter, as is evident from the cattle bones which were found at the place of occurrence.”

The Counsel for the Petitioners claimed that the impugned FIR was registered against an unknown individual and that neither the Petitioner was involved in the incident nor was he arrested on the spot.

Furthermore, it was argued that the offence under Section 5 of the Uttar Pradesh Prevention of Cow Slaughter Act, 1955, was not maintainable, and that the present impugned FIR was filed only for the purpose of harassing the Petitioners with an oblique motive.

The Government Attorney, on the other hand, contended that the impugned FIR and the Petitioners’ involvement in the crime cannot be ruled out since cow bones were discovered at the site of the occurrence.

Accordingly, the Court dismissed the Writ Petition, stating that the impugned FIR established a Cognizable Offence against the Petitioners.
