Arrest of Gujarat MLA Jignesh Mevani has been made by the Assam Police and on Sunday he was produced in front of Chief Judicial Magistrate Court in Kakrajhar District Assam against allegation of Defamatory tweet he passed against Prime Minister Narendra Modi.
Mevani was sent for Judicial Custody by Court and Judgment was reserved on his Bail till Monday.
“Considering the nature of the matter the court needs sufficient time to go through the materials on record to decide the bail petition. The Bail Petition will be decided tomorrow. Let the accused be sent to Judicial Custody till tomorrow,” said the Court order.
The complaint was filed by leader of Assam BJP against him for posting a Defamatory tweet against PM Modi that ‘Modi considered Godse as God’. Mevani was arrested from Gujarat and then flown to Assam. Mevani is independent MLA from Gujarat who pledged in support of Congress.
He firstly sent to Police Custody for three days but on Sunay Police demanded Custody of ten days.
Advocate Angushamn Bora representing Mevani has filed Bail on the ground that there is no ‘Prima Facie Evidence for Charges’ against Mevani.
“We had applied for Bail on the basis that there is no Prima Facie Evidence for the charges against him. All these sections he has been booked for…these are not applicable to the facts of this Case,” Bora told.
“Section 153A—one of the charges against him — is about promoting enmity between different groups on grounds of religion, caste, community, language etc. What he said has nothing to do with communities or religion,” he added.
Advocate Bora clarified that Arrest was in Violation of earlier Supreme Court judgement and Mevani will go in Session Court of Kokrajhar if his Bail was rejected.
To protest the Arrest of Mevani Assam Congress decided to do silent demonstration in Kokrajhar.
