Consider Steps for Quick Disposal of Bail Pleas in Prohibition Cases: Patna HC

The Patna High Court has agreed before the Supreme Court to consider setting up of designated benches to exclusively hear Bail Pleas of Accused in such Cases and said some other steps are needed to be taken to deal with the problem, including framing of norms by the Bihar Government to prevent unnecessary Arrests.

The difficulty was faced in granting timely hearing on Bail Pleas because of large number of arrests being made in Bihar under the Prohibition Law.

The High Court filed an Affidavit in Supreme Court responding to the suggestion given by Advocate Shoeb Alam for reduction of Pendency, Early Listing and Disposal of Bail Applications pending in the High Court.

The Supreme Court, which is dealing with multiple Petitions raising the the question of inordinate delay in deciding Bail Pleas by the High Courts, had asked Alam to recommend measures to be taken to deal with the problem.

The Advocate suggested a slew of measures, including Prevention of Arbitrary and unnecessary Arrests by Police and setting up of designated benches. The Patna High Court, in its response, said Constitution of designated Benches for hearing excise matters “Can be considered in a phase-wise manner”.
