Calcutta HC grants Bail to Adhikari’s aide Rakhal Bera

Calcutta High Court granted bail to BJP MLA Suvendu Adhikari’s aide Rakhal Bera, who had been detained earlier for his alleged involvement in a job racket, in which he allegedly promised a job in the State Irrigation Department in exchange for 2 lakh rupees in 2019.

Suvendu Adhikari, the leader of the opposition, was the Minister of Transport, Irrigation, and Water Resources in West Bengal at the time.

In June, four cases were filed against Bera at the district’s Contai police station. Justice Rajasekhar Matha made the following observation while granting bail to the petitioner:

“There appears to be a pattern being followed by police in coordination with one another in attempting to keep the petitioner in custody by hook or crook on one pretext or the other and by registering one FIR after the other”

The petitioner claimed that the ruling party was punishing him for changing his political membership and being close to the current Opposition Leader, Suvendu Adhikari.

As a result, he was being charged with bogus charges. An injunction was obtained from the Court to prevent the police from conducting any further investigation into the case in addition to the prayer of the bail. 

In light of the fact that repeated attempts have been made to lodge one complaint after another against the petitioner deliberately and systematically, to keep the petitioner imprisoned, Justice Mantha stated that bail should be granted to the petitioner.

As a result, the petitioner was granted bail with the following conditions:

• In all pending cases against him, the petitioner must cooperate in all investigations.

• The State is ordered to furnish a list of all cases pending against the petitioner throughout the State once more.

• This Court is also disposed to order that while all police stations in the State may file a complaint against the petitioner, he may not be arrested without the express permission of this Court.

The affidavit-in-opposition must be filed within four weeks of the order’s date. The Court ordered a response, if any, to be filed within two weeks.
