Byculla Rioting Case: Sessions Court Denies Bail to Former Media Executive Indrani Mukerjea

A Sessions Court while directing its Order disallowed Anticipatory Bail to Former Media Executive Indrani Mukerjea in a case registered against her on charges of rioting at Byculla Jail.

The single-judge Bench of Justice Nitin Sambre highlighted that since Mukerjea is already in Prison, a pre-arrest Bail Petition is not sustainable.

Mukerjea is in Prison since 2015 for alleged Murder of her daughter Sheena Bora.

Further among other persons held liable, Divya Pahuja, also submitted a pre-arrest Bail Plea. Pahuja has been in Jail since 2016 for her participation in a Fake Encounter of a Haryana-based Gangster.

The special CBI court had earlier also rejected her bail applications multiple times and recently the High court has also rejected Indrani’s bail application on merits.

Furthermore, the Court highlighted the precedents laid down in various cases , in particular a previous Rajasthan High Court Order, which observed  that an Anticipatory Bail application is not maintainable if an accused is already in Jail in another case.

Over 30 women inmates at Byculla Jail were observed by the Mumbai Police Crime Branch in a Rioting Case after an Investigation into the death of inmate Manjula Shetye in 2017. Previously, a Charge sheet was submitted in the case following which Mukerjea and Pahuja had appealed before the Court pleading a pre-arrest Bail.
