Bombay High Court said Union Govt is accountable if patients die due to PM Cares ventilators

In a significant judgement, the Bombay High Court said that, it would be the responsibility of the Centre in case any faulty ventilators supplied by a Gujarat Company through the PM CARES Fund caused the deaths of COVID-19 patients. 

The Division Bench comprising Justice Ravindra Ghuge and Justice B.U Debadwar said in the verdict that they would “Not permit experimentation of ventilators which have undergone major repairs in treating the patients since this would be causing a risk/health hazard to the patients, and unfortunately, the use of such ventilators may cause loss of life, which must be averted”.

The matter pertains to 150 ventilators provided to the Government Medical College & Hospital (GMCH) which suffered continuous breakdowns despite repairs, therefore, the machines were not used further as a precautionary measure. 

However, the court has adjourned the case till June 7, after the Additional Solicitor General affirmed the court that a team comprising expert doctors from Ram Manohar Lohia Hospital and Safdarjung Hospital, would go to Mumbai to test the performance of the ventilators on 4th June.
