Bombay HC: Varavara Rao to submit fresh Petition for extension of Medical Bail

The Bombay High Court directed P Varavara Rao Accused in Bhima Koregaon-Elgar Parishad Case to submit a new Plea to further extend the Interim Medical Bail granted to him on February 22, 2021 for six months.

A Bench comprising of Justices Nitin Jamdar and Sarang Kotwal observed that the Bail cannot be modified due to the obligations imposed by the previous Bench, hence a new Substantive Petition would be required.

The bench extended Rao’s time to Surrender till December 2 in the Interim.

Rao highlighted in the Petition, his deteriorating health and the unaffordable high cost of living in Mumbai with his 72-year old wife as reasons to receive a Bail.

Senior Advocate Anand Grover representing Rao Alleged that Varavara had undergone a Laparoscopic Surgery and was admitted in a Private Hospital between November 6-16, and hence cannot be further Jailed.

Special Public Prosecutor Sandesh Patil representing National Investigation Agency (NIA) pleaded for Rao to be examined by doctors at the State-run Sir JJ Group of Hospitals.

Further the Bench noted that Rao should be re-examined by doctors was earlier treated at Nanavati Hospital.

The National Investigation Agency (NIA) further while challenging Rao’s Petition highlighted that medical reports don’t reveal any ‘Major Ailment’ which constitutes to extension of Bail or concerns him to reside at his home in Hyderabad.

Rao and 14 other Activists were Accused by the National Investigation Agency (NIA) of furthering the banned CPI(Maoist)’s agenda and conspiring to overthrow the Government.

They are booked under the stringent Unlawful Activities (Prevention) Act (UAPA) based on letters/emails primarily retrieved from their electronic devices.

The Court adjourned the Matter for a further Hearing on November 29.
