Bombay HC: Transfer Narmada Akka to hospice for palliative care

The Bombay High Court today ordered the State Government to shift Nirmala Uppuganti also known as Narmada Akka to a hospice before 15th September for palliative care.

A Division Bench comprising Justices SS Shinde and NJ Jamadar passed the Order.

Nirmala was arrested in 2019 for alleged involvement in the Gadchiroli Naxal Attack of 2019 which led to the death of 15 Police Officers and 1 Civilian.

She along with her husband was allegedly a senior member of a banned organisation named the Communist Party of India (Maoist).

Nirmala then filed a Plea before the Bombay High Court seeking relief or transfer to a care facility as she was diagnosed with breast cancer in 2018.

Advocate Payoshi Roy on behalf of her client Nirmala stated before the Court that she has stage four cancer and multiple skeletal and lung metastases so she urged before the Court that she be allowed to meet her husband in her final days.

The Petitioner also stated before the Court that Byculla Women’s Prison where she was being held gave no basic facilities to the inmates such as hot water, toilet etc and also she had to sleep on the floor as it was a crowded prison cell.

The Public Prosecutor argued that the Petitioner was being taken to the TATA Memorial Care Centre thrice a week on alternate days without fail to ensure she gets her treatment as directed by her doctors.

The Bench after hearing the arguments reserved its Plea for Orders on 7th September.
