Bombay HC refuses interim relief on Anil Deshmukh plea

The Bombay High Court refused to grant interim relief to former Home Minister Anil Deshmukh in the case filed by the Central Bureau of Investigation (CBI).

Former Mumbai Police Commissioner, Param Bir Singh charged him of bribery, corruption and criminal conspiracy,

Anil Deshmukh had filed the petition before the Bombay High Court in order to quash the First Information Report (FIR) registered by the CBI against him.

Additional Solicitor General, Anil Singh, representing the CBI, requested time to take instructions. 

He stated that he needed some time because the CBI had only been served with a copy of the petition last evening.

Senior Counsel Amit Desai for Deshmukh argued that his client was merely seeking interim relief from coercive action.

However, a Bench of Justices SS Shinde and Manish Pitale refused to issue such a directive, in view that the Court could not grant relief without first hearing the respondents.

The Court adjourned the hearing granting the CBI 4-weeks time to respond to the plea and granted the liberty to approach the vacation bench with 48-hour notice to respondent to the CBI in case of extreme urgency.

“However, the petitioner has the liberty to move before the vacation bench with 48-hour prior notice to the other side in case of extreme urgency,” the Bombay High Court said.

The High Court granted the state government permission to file a petition before the vacation bench seeking to strike two ‘unnumbered paragraphs’ from the corruption FIR filed by the CBI on April 21 against Deshmukh and other unknown individuals.
