Bombay HC quashes FIR filed by wife after couple settles amicably; says Miya Biwi Raazi

In the case of Dr V B Jadhav Vs. the State of Maharashtra, the Bombay High Court revoked an FIR about domestic violence against the husband when the petitioner (wife) stated that they had settled between them and living together.

A bench comprising Justice S S Shinde and Justice M S Karnik told the petitioner lawyer AB Patil that no need to submit any further legal papers.

Justice M S Karnik said, “Haven’t you heard of the saying, “Jab Miya Biwi Raazi…?”

The husband filed an appeal for revoking the FIR to the Bombay HC as he was charged under Sections 498A (cruelty by husband), 324 (voluntary hurt), 377 (unnatural offences) 504, 506, 507 (criminal intimidation), 354D (stalking) of Indian Penal Code and Sections 67, 67A (publishing obscene material online) of the Information Technology Act).

Both husband and wife are doctors by profession.

Justice Shinde said that, “We have the highest regard for doctors and we know how much pressure they work in.”

Later, the wife stated that they faced some misunderstanding but, since September, they were living together.
