Bombay HC: MC to submit Affidavit of Vaccinated bedridden People

Bombay High Court has issued an Order directing the Municipal Corporation (MC) to file a short affidavit regarding the number of bedridden and immobile individuals who have been vaccinated since the time such a drive to vaccinate them started.

The Division Bench comprising Chief Justice Dipankar Dutta and Justice G. S. Kulkarni has issued this order in pursuance of the “State Policy for Covid-19 Vaccination for Bedridden and Immobile Individuals”.

The State Government reported to the Court that the Municipal Corporation has started the initiation of the vaccination drive for the bedridden and immobile individuals. However, to date, no adverse incidents have been reported.

The Municipal Corporation has reported that 4715 citizens registered for home vaccination among whom 602 citizens have been successfully vaccinated.

The petitioner highlighted to the Court that certain areas need improvements. She stated that it was likely that the private hospitals’ doctors can be resistant enough to certify that an individual is fit for vaccination or that he/she may not suffer Adverse Effects Following Immunization (AEFI).

The petitioner submitted a subsequent option that the doctors of the Municipal Corporation can be permitted to examine such individual’s physical conditions to get vaccinated.

The Court directed the State Government to take into consideration all the submissions made by the petitioner and if found suitable, then implement them further.

The Court further directed the Municipal Corporation “To file a short affidavit indicating therein the number of bedridden and immobile individuals who have been vaccinated since the drive started and whether AEFI was felt by any individual. The Municipal Corporation shall also indicate the exact role of the NGOs in such drives in its affidavit.”

The Court has directed to submit such affidavits by August 11 and has decided to hear the matter on 12th August.
