Bombay HC Imposes Cost of 5000 on Law Firm For Disclosing Name Of Rape Victim In Petition

Bombay High Court Bench of Justices Revati Mohite Dere and Prithviraj Chavan has expressed displeasure with the disclosure of a rape victim’s name in a case and imposed a fine of Rs 5000 on the law firm that had drafted the petition.

Bombay High Court passed order while dealing with a plea filed by an accused who sought to quash the FIR registered against him u.s 376, 420 and 406 IPC registered by the Pune police.

Bombay High Court Bench said that many times lawyers don’t refrain from mentioning the name of the victim even though Section 228A IPC mandates non-disclosure of the name of a rape victim.

Adv Zaid Anwar Qureshi instructed Hulyalkar & Associates (a law firm) appeared for the petitioner and sought permission to amend the petition and mask the prosecutrix’s name wherever it appears in the plea including the title.

High Court allowed the amendment but imposed a cost of Rs 5000 on the law firm.
