Bombay HC Bench Recuses from Hearing Hany Babu, Gautam Navlakha Pleas in Elgar Case

A two-judge Bench of the Bombay High Court recused itself from hearing the Bail Plea of Delhi University’s Associate Professor Hany Babu and the Plea of Gautam Navlakha.

Babu’s Bail application was being heard by a panel of Justices Revati Mohite Dere and V.G. Bisht, who stated that the supposed letter presented by the National Investigating Agency (NIA), alleging a conspiracy to kill Prime Minister Narendra Modi, did not incriminate him.

When Babu’s case came before a Bench comprising Justices Revati Mohite-Dere and VG Bisht, the Court recused itself from hearing it for no apparent reason.

Justice Mohite-Dere also declined to hear Navlakha’s Plea, in which he requested, among other things, access to his phone calls at the Taloja prison in Navi Mumbai, where he is currently detained as an under trial.

The Judge had said that the letter spoke of a “Rajiv Gandhi assassination like conspiracy” to kill Modi and that it incriminated Babu in the case.

Babu stated in his Plea that there was no proof that he planned to, or supported, inciting dissatisfaction with India.

The Plea noted that the case’s trial had yet to begin and that it would take time to complete because the NIA had called over 50 witnesses and the chargesheet was 30,000 pages long.

Hany Babu urged the HC to grant him Bail.

Babu, who was arrested in July 2020, from his residence in Delhi, is also lodged at the Taloja Prison.

The pleas of Babu and Navlakha will come up for hearing before an appropriate Bench later this month.
