Ambiguous information in election affidavit: Delhi Court summons BJP MP Hans Raj

A Delhi Court issued summons to the BJP Lok Sabha Member, Hans Raj Hans in relation to his providing ambiguous information in the Election affidavit in connection with the 2019 Lok Sabha Elections.

The summons was issued by the Additional Chief Metropolitan Magistrate, Dharmendra Singh, on 13th January 2021.

The complaint was registered by Rajesh Lilothia who is a member of the Indian National Congress.

Rajesh Lilothia had contested the 2019 Lok Sabha Elections from North West Delhi representing Congress and stood third while Hans Raj emerged victorious.

Advocates Sunil Kumar and Vikram Dua are representing the complainant.

In the present case, it is alleged that the Punjabi Singer who later on turned into a Politician had falsely provided information regarding his educational qualification and tax liabilities of his and his family which is unclear and ambiguous.

The case is connected with the Representation of People Act, 1951 and the Delhi Police had filed a charge sheet under section 125(A) of the aforesaid act.

“Cognizance of offence under 125 (A) Representation of People Act is taken. Accused (Hans) be summoned for next date on January 18”, the Court stated.

Section 125(A) of the RP Act provides punishment for furnishing false information or for concealing any information in the nomination papers with an intent of getting elected.

The punishment is imprisonment which may be extended to six months, or fine, or both.

The Court also ordered for further investigation by the police in connection with the case and directed the collected material to be filed in the Court in a supplementary charge sheet.

“So far as the addition of sections of Indian Penal Code are concerned same shall be considered by this court at the time of consideration of charge,” the Court said.

This is not the first time that the Singer-Politician is caught up with a criminal charge. Earlier, a criminal charge of defamation was filed by the Delhi Deputy Chief Minister, Manish Sisodia against some BJP leaders including Hans Raj. Though earlier they were granted bail, the matter is not settled completely.
