Allahabad HC: Trace Corpus of Covid Patient missing from Hospital

The Allahabad High Court on Wednesday demanded tracing of the corpus in a Habeas Corpus Petition which sought the tracing of an 82-year-old COVID patient who went missing from Prayagraj’s TB Sapru Hospital.

The Bench of Justice Surya Prakash Kesarwani and Justice Piyush Agrawal stated, “Government Authorities didn’t raise any objection as to the maintainability of the Habeas Plea in light of the fact that the State has preferred an Special Leave Petition (SLP), against the Allahabad High Court order dated August 28 in the instant matter.”

The High Court made several observations in its August 28 Order (against which an SLP has been filed) regarding required medical equipment, CCTV cameras, etc as per State Government standards and norms in various hospitals, including the hospital in question.

On September 13, the Court was informed that the State had filed an SLP before the Supreme Court, and, therefore, the Court emphasised that the major issue in the current case was the tracing of the corpus.

The Court noted that the maintainability of the Writ Petition was not challenged, even after the Respondents were given two opportunities to object.

Accordingly, the Additional Chief Secretary and the Senior Superintendent of Police, Prayagraj, were instructed to trace and produce the corpus before the Court on the next scheduled date.
