Allahabad HC Suspends Sentence Imposed on Disqualified BJP MLA Vikram Saini & Grants Bail [2013 Muzaffarnagar Riots Case]

The Allahabad High Court on suspended the 2-year-old sentence imposed on BJP MLA, Vikram Saini in connection with the 2013 Muzaffarnagar riots case and ordered to list the hearing for suspension of his conviction for Monday.

On October 10 this year, a special MP/MLA court in Muzaffarnagar had sentenced Saini and 10 others to two years’ imprisonment in a case relating to 2013 Muzaffarnagar riots.

His two-year prison sentence was suspended by bench of Justice Samit Gopal. The high court was hearing an appeal by Saini challenging his conviction by a special court.

The bench granted his bail application while admitting his appeal challenging his conviction in a 2013 riots case in Muzaffarnagar. He challenged charges under Section 147 (rioting)148 (rioting armed with deadly weapons)336 (act endangering life or personal safety of others)353 assault or criminal force to deter public servant from discharge of his duty504 (intentional insult with intent to provoke breach of peace) and 506 (criminal intimidation) of IPC.

The former BJP MLA was arrested in connection with the riots in the Muzaffarnagar, the violence had left at least 60 people dead and over 50,000 people were reportedly displaced.

Examining all the facts submitted before the Court the bench allowed his bail application, observing that:

“Looking to the facts and circumstances of the case, let the appellant- Vikram Singh Saini @ Vikram Saini, be released on bail in the aforesaid case on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.”

In the present order, the high court directed Saini’s release on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.

The matter has now been listed for hearing on November 21, 2022.
