Allahabad HC: ‘Legislatures and Political People’ consider themselves above the Law

Allahabad High Court denied the Bail Plea filed by the Ex-MLA in the UP Legislative Assembly, who was sentenced by the Lower Court for assaulting a person in the Lockup.

The Allahabad Bench led by Justice Mohd. Aslam stated that, “Nowadays, the legislatures and political persons are thinking themselves as above the law. This menace cannot be lightly taken and should be dealt with iron hand.”

The Bail Plea was filed by Hasratulla Shervani (ex-MLA) requesting to suspend the Lower Court conviction and release him on Bail till the Appeal opposing the conviction order is heard.

The Lower Court convicted the latter under several Sections of Indian Penal Code (IPC) including “Attempt to Murder.”

The Allahabad High Court rejected the Bail Application of the ex-MLA but on the contrary permitted the Bail Plea of the other 8 Accused in the same Case, who had filed along with the ex-MLA (prime Accused).

The Allahabad High Court reserved their Appeal opposing the Lower Court’s Verdict for January 10, 2022.

According to the Prosecution, Samsad (informant) alleged that the Police in May, 2011 submitted a false report against him and arrested him and kept him in the Lockup.

The ex-MLA along with his supporters and relatives in August 2021 tried to kill Samsad (informant) who was in the Lockup at that time. Hasratulla Shervani had ordered the Police Officials to beat the informant to the extent that he is crippled or they would face severe consequences.

Furtherly, the ex-MLA went on the informant with the rifle and attempted to kill him but of the riffle that was stopped by S.O Ram Murti Yadav and saved the information.
