Advocate Booked Under Contempt of Court for Using ‘Ugly & Harsh Words’ Before District Judge

The Division Bench of Justice Arvind Kumar Mishra-I and Justice Manish Mathur issued Notice to the Advocate against whom the Contempt complaint is filed for uttering ‘ugly and harsh words’ to District Judge.

The Judge Rabindra Kumar sent a letter to Allahabad High Court to register the Contempt Petition against Advocate Sharad Kumar Gupta.

It was pointed in the letter that on December 2021, during the hearing in Court of District Judge, Motor Accident Claims Tribunal, Hardoi, advocate got infuriated and uttered ugly and harsh words which lower the dignity of the Court.

“We upon careful perusal of entirety of the Case find it is case for interference considering the entirety of this Case, dignity and honour of the Judiciary and Prima Facie, find upon perusal of the report dated 10.12.2021 that the act committed by Mr. Sharad Kumar Gupta, Advocate comes within the purview of Criminal Contempt as defined under Section 2(c) of the Contempt of Courts Act, 1971 since it scandalises or tends to scandalise and lower the authority of the Court concerned.” Court observed.

The Court asked the Advocate to present before High Court and file the reason for not initiating Contempt Proceeding against him.

This matter is adjourned till July 15.
