2G Spectrum Scam: New bench to hear CBI’s appeal in Delhi HC

The Delhi High Court’s different bench will hear the appeal filed by the CBI (Central Bureau of Investigation) against the release of all accused, involving former telecom minister in the 2G spectrum scam.

Justice Yogesh Khanna will hear the matter on December 1 as Justice Brijesh Sethi is set to retire.

Justice Sethi had earlier declined several petitions of acquitted accused against the Central government’s sanction for CBI to challenge their acquittal.

The Delhi High Court had also rejected the plea by observing that the CBI had challenged the acquittal without putting on record the necessary consent by the Central government.

A special CBI Court, in 2017, had acquitted DMK politicians A Raja, Kanimozhi, along with 15 others, in the 2G spectrum scam case.

Based on ‘leave to appeal’ filed by the CBI, the Delhi HC started hearing the case after the trial court had acquitted the accused.

‘Leave to appeal’ is a formal approval granted by a court to a party approach the higher court against the decision.
