Delhi HC extends Deadline of Linking Aadhar with UAN

The Delhi High Court passed an order to extend the deadline for Aadhar-UAN (Universal Account Number) linkage of employees working in establishments and industries, till November 30, 2021.

“Insofar as those persons for whom the Aadhaar number seeding is yet to take place are concerned, the date for completing the seeding and verification shall stand extended till November 30, 2021. In the meantime, employers shall be permitted to deposit the provident funds in respect of employees for whom seeding has not taken place and no coercive measures shall be taken against them for non-seeding of Aadhaar numbers with UANs,” read the Order.

The Bench of Justice Prathiba M Singh decided that till this date, employers can store the fortunate assets in regard of representatives for whom cultivating was not done.

“Until and unless the issue of whether mandatory seeding is legally valid or not is determined, as per Aadhaar judgement, there cannot be any exclusion of benefits to employees under the Act, due to failure to authenticate or verify with Aadhaar,” stated the Order.

The Court likewise requested that no coercive measures will be taken against the employers for now for postponed installments because of specialized hardships from June 1 to 15.

The Order explained that the Employees’ Provident Fund Organization (EPFO) would delegate a Grievance Redressal Officer who can be reached by the applicant’s individuals or some other manager to guarantee that the stores are not deferred.

The Delhi HC ordered to expand the Aadhaar-UAN connecting cutoff time came against an appeal by the Association of Industries and Institutions.

It moved the court, against an EPFO round dated June 1, which made the cultivating of Aadhaar number alongside the UAN, produced under the Employees Provident Fund and Miscellaneous Provisions Act, 1952, obligatory.

The Petitioner battled that tremendous bias was being caused to the employers because of the EFPO’s structure.

It said that in specific occurrences, there was a befuddle between the Aadhaar information base and the EPFO data set, and the businesses were being compelled to not utilize those laborers/representatives, who don’t have legitimate Aadhaar cards.

The Court was educated that the complete number of workers whose approval is yet to be done is just 29,26,479.

Linkage of workers’ Aadhaar cards with their UAN was made obligatory by the EPFO in June 2020.
