J&K HC quashes detention order of Masarat Alam Bhat

The Jammu and Kashmir High Court has quashed the detention order and released the Chairman of the Jammu Kashmir Muslim League Masarat Alam Bhat.

The High Court directed the administration to release him as he is not required further for any case.

The High Court Division Bench of Justice Saneev Kumar and Justice Rajnesh Oswal stated that the detention order is now infructuous as it has outlived its life.

The separatist leader had challenged the decision of a single bench, which had dismissed the plea against the 36th detention order by District Magistrate Kupwara.

Bhat had submitted before the single bench that “the authorities were relentlessly passing detention orders on the grounds that run afoul of the Constitution and the safeguards inbuilt in the preventive detention statute on the routine basis in blatant violation of the court orders.”
