Writ filed at Nepal SC seeking dismissal of cabinet restructuring

Three lawyers have filed a writ petition at the Supreme Court challenging that the reorganization of KP Sharma Oli Cabinet be scrapped because Oli has been reduced to a caretaker PM after he dissolved the House of Representatives on December 20.

Advocates Lokendra Oli, Keshar Jung KC, and Dinesh Lamichhane have together filed the writ petition as article 77(1) of the constitution that states that a person who is not a member of Parliament cannot be a Prime Minister and a minister.

While registering the writ petition, the petitioners also urged that the Supreme Court must issue an interim order to not apply the decision of 25 December of Cabinet restructuring.

The defendants in the matter were the Office of the President, Office of the Prime Minister, and Council of Ministers.

Various constitutional experts and leaders have expressed criticism forwards Oli’s decision to reorganize his cabinet, claiming that the caretaker of the government cannot make critical decisions.

After the Prime Minister’s suggestions of House dissolution was validated by President Bidya Devi Bhandari on December 20, seven ministers of the Oli government had resigned en masse.
